PGR abre investigação para apurar apagão de dados na Saúde

A Procuradoria-Geral da República (PGR) informou ao Supremo Tribunal Federal (STF) que abriu investigação preliminar para apurar o chamado 'apagão de dados' do Ministério da Saúde, após ataque hacker no dia 10 de dezembro do ano passado. A informação foi repassada pela procuradoria na última sexta-feira (18), em documento datado do dia 11 de fevereiro.

Nele, o vice-procurador-geral da República, Humberto Jacques de Medeiros, pontua que já há um inquérito na Polícia Federal sobre o assunto e que solicitou à corporação a remessa de informações acerca das investigações sobre as circunstâncias do suposto ataque cibernético nos bancos de dados do ministério. 

No âmbito do Supremo, um pedido de investigação foi enviado por deputados federais do PT e está com o ministro Gilmar Mendes. No documento, eles pedem a apuração sobre o ministro da Saúde, Marcelo Queiroga. Os parlamentares atribuem a Queiroga a prática de prevaricação e infração de medida sanitária preventiva, afirmando que o governo adotou uma medida negacionista no âmbito da pandemia.

Na petição, os deputados afirmam que, desde o dia 10 dezembro, quando houve o ataque, o ministério não mais apresentava dados estatísticos confiáveis sobre a situação sanitária do país. Os parlamentares apontaram que o ministério ainda não havia dado solução ao apagão dos dados, após a invasão ao sistema, e que, diante disso, não era possível mensurar a real situação do país no âmbito da pandemia.

Para a PGR, entretanto, não era o caso de remeter a referida petição ao STF, e sim à procuradoria. Por isso, o vice-procurador pede o arquivamento dos autos no Supremo e diz que já abriu investigação preliminar na procuradoria. Além disso, Medeiros defende que Queiroga não possui foro privilegiado, e que por isso ele precisa ser processado no primeiro grau do sistema Judiciário.

O despacho da PGR atende a pedido enviado pelo ministro Gilmar Mendes no último dia 27. Na ocasião, ele solicitou manifestação da procuradoria sobre o pedido de investigação contra Queiroga.

Pelo Twitter, o ministro Gilmar Mendes já havia comentado a situação anteriormente, no dia 10 de janeiro. "O restabelecimento dos sistemas de atualização dos boletins epidemiológicos deve ser tratado como prioridade. Há semanas os Estados e Municípios enfrentam dificuldades em informar os casos de contaminação e de internação. O #ApagaoNaSaude inviabiliza o enfrentamento da pandemia", pontuou.
